It’s All Fun and Games until Someone Gets Sued

Your Mom used to warn you to be careful when playing around. Life was simpler in Canada a few years ago when people would take responsibility for the risks they assume when participating in activities. Fast forward to 2017 and Canada is much more litigious. Canadians used to poke fun at our American cousins as it seemed like suing was a national pastime in the US. Personal injury lawyers are aggressive. They will cast a wide net to catch anyone remotely involved in a situation where someone is injured.

Defending Lawsuits is Expensive
If you are named in a statement of claim then you are required to respond and issue a statement of defence. The average hourly cost for a lawyer in Canada is $362. You can be certain that the cost is higher in major urban centres when retaining a lawyer experienced in defending liability lawsuits. Hiring a lawyer to issue a statement of defence on your behalf to simply have you removed from the lawsuit is likely a minimum of $10,000.
